They’re contractually committed to preserving the privacy of the data they manage. It’s pivotal to recognize that many service entities, including Eco Fusion Tech, are US-based but have an international operational footprint. Hence, be informed that your personal data might undergo processing in nations other than your domicile, and these nations might adopt diverse data protection standards than your home country.

20. Information for EU Citizens Regarding Data Transfers to the US

While our base and numerous service associates are located in the United States, we operate on a global scale. Not only do we make sure these providers adhere to the rules on handling and sharing personal data, our collaborations with them encompass the legal frameworks that ensure personal data transfers align with European data protection regulations. This usually involves adhering to the EU-U.S. Privacy Shield principles or utilizing standard contractual agreements, commonly referred to as model clauses.

21. Addendum for EU Data Management

We at Eco Fusion Tech strictly adhere to the highest standards of privacy and data protection laws relevant to the processing of personal data. This includes adherence to the provisions of the General Data Protection Regulation 2016/679 enacted by the European Parliament and the Council on 27 April 2016, which is designed to safeguard individual rights concerning data processing and its free circulation (“GDPR”). Enterprises that handle data of EU citizens can seek our data processing supplementary document from Eco Fusion Tech. This document integrates the standard contract terms. Additionally, or as an alternative based on the situation, they can depend on Eco Fusion Tech’s EU-U.S. Privacy Shield recognition, detailed further in section 27.

22. Understanding Controllers, Processors, and GDPR Rights at Eco Fusion Tech

In the context of GDPR, a “processor” refers to an individual or organization that manages personal data under the directives of the controller. The “controller” at Eco Fusion Tech is the entity that establishes the purposes and methods for processing personal information. It’s essential to understand that not all involved in personal data handling bear the same level of accountability. Predominantly, controllers at Eco Fusion Tech are entrusted with ensuring that EU citizens can effectively exercise their GDPR-defined rights, known as “data subject rights”. These rights encompass, but aren’t limited to, the rights of an individual to view, modify, limit the handling of, and/or erase their personal data.

23. Eco Fusion Tech’s Role as a Processor for Business Partners

When it comes to our business partners, our services are designed to be utilized and overseen by the partner. Typically, we gather and manage personal data in association with a business partner’s use of our services on their behalf. In these scenarios, the business partner functions as the controller, while Eco Fusion Tech serves as a processor, adhering to the directions provided by the business partner. If you’re an EU citizen and suspect that Eco Fusion Tech is managing your personal details on behalf of a business partner, and wish to exercise your data subject rights, we recommend reaching out to the respective business partner first.

24. Eco Fusion Tech’s Role as a Processor for Individual Users

If you are an individual EU user utilizing Eco Fusion Tech Services, you hold the control over the personal data that you manage via our Services. Individual users can access, rectify, limit processing of, and erase their personal data through the features provided by our Services. Should you have further inquiries, please reach out to us as detailed in paragraph 5.

25. Eco Fusion Tech’s Role as a Controller

For scenarios like when personal data is utilized by Eco Fusion Tech for handling a user’s account, billing, and promotional activities, Eco Fusion Tech assumes the role of the controller in relation to personal data. If you’re an EU resident and we act as the controller of your personal data and you wish to exercise your rights concerning this data, please reach out to us as outlined in paragraph 5.

26. Legal Grounds for Processing Data

The GDPR mandates that data related to individuals be processed legitimately, specifying clear legal grounds for such processing. As explained in paragraphs 6 to 10, we shed light on the personal data we might gather and, in paragraph 11, how we might utilize it. The legal grounds as per GDPR for these uses hinge on the nature of the personal data acquired and the circumstances surrounding its acquisition. Eco Fusion Tech has identified the legal ground for every use, encompassing:

  • Carrying out a contract or taking measures associated with a contract, like delivering Services to you as an individual client;
  • Balancing our interests against yours, ensuring our interests don’t infringe upon your basic rights and freedoms, aiming for legitimate business-related interests, such as handling the data of our EU staff members;
  • Handling your personal data upon receiving your explicit permission, for instance, when you complete an online form with your contact details on our platform, asking us to connect with you regarding our Services; and
  • Meeting legal requirements, like responding to legitimate demands made by governmental bodies.

27. Data Protection Framework

As highlighted, Eco Fusion Tech adheres to and has confirmed its alignment with the EU-U.S. Data Protection Framework.

  • We ensure that all personal data acquired from EU member nations and the United Kingdom, with trust in the Data Protection Framework, aligns with the principles of this Framework. To gain more insights about the Data Protection Framework and to see our certification, please visit the U.S. Commerce Department’s Data Protection website, where a comprehensive list of all participants of the Data Protection Framework is maintained.
  • Eco Fusion Tech takes responsibility for the handling of personal data it gathers under the Data Protection Framework and might transfer it to a third party who represents us. We adhere to the Framework’s principles for all subsequent data transfers from the EU and the UK, which includes provisions related to liability for such transfers.
  • Regarding the personal data that we obtain or transfer in line with the Data Protection Framework, we fall under the regulatory authority of the U.S. Federal Trade Commission. In specific scenarios, we might be obligated to share personal data following lawful orders from official bodies, which can be due to national security or law enforcement necessities.

Eco Fusion Tech is informed about the ruling from the European Communities’ Court of Justice regarding the Data Protection Framework. We are closely monitoring these developments and offering standard contractual clauses to our clients who require them and haven’t yet implemented them. Meanwhile, we remain dedicated to safeguarding EU personal data in line with GDPR and the principles of the Data Protection Framework.

28. Employee Data

This Policy outlines the guidelines by which Eco Fusion Tech handles the processing of personal data acquired from its staff in the EU for its human resources functions. Eco Fusion Tech pledges to collaborate with EU data protection agencies concerning any outstanding EU-U.S. Data Protection Framework grievances related to the transfer of HR data from the EU within the framework of the work relationship.

29. Questions and Grievances

In line with the EU-U.S. Data Protection Framework, we strive to address concerns about our gathering or utilization of EU citizens’ personal data. If you have questions or grievances related to this Policy, we kindly ask EU citizens to initially reach out to Eco Fusion Tech as detailed in section 5. Additionally, individuals can consult their regional data protection body (known as the supervisory entity in GDPR terms) for more insights regarding their rights and our responsibilities concerning their personal details.
